Ces revendications d\u00e9coulent de la distorsion r\u00e9elle de la concurrence \u00e0 laquelle sont confront\u00e9es de nombreuses entreprises suisses lorsque des prestataires internationaux tels que Temu, Shein ou AliExpress op\u00e8rent de facto dans un cadre juridique diff\u00e9rent. <\/p>\n                    \n                    <div class=\"intro-text-left-block-texteditor\">\n                        <p>Les prises de position du Conseil f\u00e9d\u00e9ral refl\u00e8tent malheureusement une perspective administrative d\u00e9fensive : les probl\u00e8mes sont identifi\u00e9s, mais trait\u00e9s principalement par le biais de r\u00e9visions partielles existantes ou pr\u00e9vues. Il faut certes saluer la volont\u00e9 du Conseil f\u00e9d\u00e9ral d\u2019adapter la LSPro et la LCO. Du point de vue du commerce, cela reste toutefois insuffisant.<\/p>\n<p>Le Conseil f\u00e9d\u00e9ral tente de r\u00e9soudre les probl\u00e8mes de concurrence r\u00e9cents \u00e0 l\u2019aide d\u2019instruments existants, sans s\u2019attaquer clairement aux causes. Le fait que des r\u00e9visions de la LSPro et de la LCO soient \u00ab envisag\u00e9es \u00bb est certes positif, mais cela ne change actuellement rien \u00e0 l\u2019ins\u00e9curit\u00e9 juridique \u00e0 laquelle sont confront\u00e9es les entreprises au quotidien.<\/p>\n<p><strong>Des r\u00e8gles du jeu \u00e9quitables pour tous les prestataires<\/strong><\/p>\n<p>Le d\u00e9bat au Conseil des \u00c9tats a clairement montr\u00e9 que le probl\u00e8me est reconnu par tous les partis. Plusieurs interventions ont fait r\u00e9f\u00e9rence \u00e0 l\u2019augmentation forte du nombre de petits colis en provenance de pays tiers, qui ne peuvent \u00eatre contr\u00f4l\u00e9s que de mani\u00e8re limit\u00e9e, ainsi qu\u2019aux risques li\u00e9s \u00e0 la s\u00e9curit\u00e9 et \u00e0 la qualit\u00e9 des produits provenant de plateformes en ligne. Les partisans ont fait valoir que si les prescriptions existantes s\u2019appliquent, leur mise en \u0153uvre dans le commerce num\u00e9rique reste insuffisante. Des voix critiques ont mis en garde contre une bureaucratie suppl\u00e9mentaire ou une mise en \u0153uvre difficile. L\u2019auteur de la motion, Benedikt W\u00fcrth, a r\u00e9sum\u00e9 la situation de mani\u00e8re concise : \u00ab Il s\u2019agit d\u2019assurer des conditions \u00e9quitables pour tous les prestataires du commerce en ligne. \u00bb<\/p>\n<p><strong>Des lacunes subsistent<\/strong><\/p>\n<p>Commerce Suisse se r\u00e9jouit que le Conseil des \u00c9tats ait reconnu la n\u00e9cessit\u00e9 d\u2019agir et ait adopt\u00e9 les deux interventions. Cette d\u00e9cision montre que le probl\u00e8me des conditions de concurrence in\u00e9gales dans le commerce en ligne est \u00e9galement per\u00e7u au niveau parlementaire et qu\u2019une pression politique s\u2019exerce pour faire avancer des solutions concr\u00e8tes.<\/p>\n<p>Quiconque exerce son activit\u00e9 en Suisse respecte les r\u00e9glementations et fait l\u2019objet de contr\u00f4les. Ceux qui vendent depuis l\u2019\u00e9tranger se soustraient souvent \u00e0 cette responsabilit\u00e9. Ce d\u00e9s\u00e9quilibre affecte la comp\u00e9titivit\u00e9 pratique sur le terrain.<\/p>\n<p>Les secteurs du commerce ont besoin de r\u00e8gles du jeu claires, applicables et \u00e9quitables dans un monde commercial globalis\u00e9 et num\u00e9ris\u00e9. Ce n\u2019est que lorsque les m\u00eames obligations s\u2019appliquent \u00e0 tous les prestataires \u2013 et que celles-ci sont contr\u00f4l\u00e9es \u2013 qu\u2019une concurrence loyale peut s\u2019instaurer.<\/p>\n<p>Commerce Suisse reste vigilant et continue de s\u2019engager pour que des r\u00e8gles identiques et efficacement appliqu\u00e9es s\u2019appliquent \u00e0 tous les
